Iraq veteran proves he violated probation on Facebook

Judge: Marine violated terms of release

DANVERS — A Salem District Court judge has found “clear and convincing” evidence that Marine recruiter Matthew Fairbanks repeatedly violated the terms of his release in a pending assault and battery and weapons case, including failing to surrender an AK-47 to police.

Because of that, Judge Robert Brennan concluded that Fairbanks “poses a substantial risk of danger to the community” and ordered that he now be held without bail until trial.

Fairbanks, 23, an Iraq War veteran whose family has said may be suffering from Post Traumatic Stress Disorder, was living in the Endicott Greens apartment complex on Route 1 in January when police were called because of a disturbance in his apartment.

Fairbanks allegedly ripped a toilet out of a wall during the altercation with his 52-year-old father, and then used it to assault the older man, according to police. Officers subsequently found guns and other weapons in the apartment and in Fairbanks’ car.
Then, last month, police and probation officers learned that Fairbanks had posted a photo of himself on Facebook laughing and holding an AK-47 with a caption that said, “So then the judge says to me, he says, you will surrender all your firearms.”

    SGT Matthew Fairbanks is a decorated Marine and a wonderful human being. SGT Fairbanks was ordered to leave the state by the U.S.M.C. His Probation Officier (Goff) was grossly inept in his responsibilities to the Commonwealth and his position by not even making one phone call to inquire why SGT Fairbanks had missed several appointments. District Attorney Grimes has intentionally and willfully caused this young man tremendous angst in the attempt to hide DA Grimes anger at the "egg on his face". It sickens me to see the Commonwealth "hacks" hurting a decorated Marine intentionally. Let us watch what the Salem News prints about his charges being dropped entirely. Looks like his lawyer Mr Michael Walsh has much more class and brains than DA Grimes and PO Goff combined.

  2. I cannot agree for a very simple reason. Veterans are finally being treated as veterans and not lumped in with selfish common criminals because the extenuating circumstances behind what they are accused of doing.

    No other generation before OEF and OIF have been granted a special court. They have to follow the judges orders or they end up in jail instead of treatment.

    If any judge gives them rules to follow, including giving up guns, then they have the right to challenge the judge legally. They are not above the law but the courts are trying to make sure they have true justice. Right now it is an experiment with more and more states appointing special judges to take care of the veterans.

    Posting on Facebook just put all this hard work many have done for the sake of veterans in jeopardy.

    By the way look up Joshua Omvig Suicide Prevention Act of 2008 and know the gun rights issue tied to it. This ended up causing many veteran gun owners with PTSD to fear going for help. Stupidest thing congress could have done.
